PROFILE OF JAMES W. AVERY, ATTORNEY AT LAW
The founder and principal trial
lawyer of Avery Law Firm, James W. “Jim” Avery, has handled some of the largest
and most complex cases in the areas of personal injury, aviation, insurance bad
faith, legal malpractice, medical malpractice, product liability and
commodities fraud litigation, trucking accidents, railroad accidents, wrongful
death, etc., with top notch results.
Perhaps because of such results, and demonstrated talent in the courtroom,
Jim Avery has been recognized by peers and professionals as one of the top
lawyers in America. Jim has been named a
Super Lawyer in 2006, 2007 and 2008, representing the top 5% of
lawyers in the state. Jim Avery was
named one of the Top 100 Trial Lawyers in 2007 and 2008 by The American Trial Lawyers
Association, representing the top 1% of lawyers in the state. In 2008, Jim Avery was invited into
Fellowship of The Litigation Counsel of America, a trial lawyer honorary society whose membership is limited,
representing less than one-half of one percent of American lawyers nationwide
and is by invitation only.

Jim Avery is 52 years old, and has been
practicing law since 1982. He is married
with two children.

EDUCATION: Jim received his Bachelor of Arts degree from
Austin College in 1979, where he graduated in the top 10% of his class and was
elected to a National Honor Society in Psychology (Psi Chi), and his Juris
Doctor (J.D.) from the University of Denver in 1982 where he graduated in the
top 1/3 of his class. [Note, neither of
these colleges or universities grants degree titles such as cum laude or magna cum laude and specific numerical class rankings are not given
to graduates.]

ADMISSIONS: Jim is admitted to practice
before all courts in the states of New York, Colorado and Indiana, and has been
specially admitted to practice in courts in California, Texas, Illinois,
Florida, Arizona, and New Mexico. Jim
is admitted in various federal courts, including the Western District of New
York, District of Colorado, Northern and Southern Districts of Indiana, and the
Northern and Southern Districts of California.
PUBLICATIONS: Jim has been published in the areas of Joint
Liability of Surgeons, Surgical Malpractice, and Physician Malpractice, and is
frequently asked to speak on topics relevant to trial lawyers.
PROFESSIONAL
BACKGROUND: Prior to establishing his
own firm in 1989, Jim was an associate at the trial firms of Hansen &
Breit, P.C. (defunct) and Madden & Strate, P.C. (defunct), where he
practiced with noted trial lawyers Bob Hansen, John Breit (deceased), Bill Madden (retired) and George Strate
(retired).
COMMUNITY
SERVICE: Jim has given extensively of
his time and resources to the brain injured (his mother brain injured and
helped establish the Rochester Foundation for Persons with Brain Injury) and
people in need (he has supported Home Christian Fellowship, Persecuted
Christians Task Force and The Sudan Project).
Most notably, Jim has made numerous humanitarian aid trips to Africa to
aid victims of war torn South Sudan, where he assisted in the re-establishment
of schools, clinics and churches.
